The user must carefully read the terms and conditions contained herein before using the platform.  By voluntarily accessing and using our platform, you agree to comply with the following terms and conditions:

1. Eligibility: You must be at least 18 years old to use our services. By creating an account, you confirm that you meet this requirement.
2. User Responsibilities: You agree to provide accurate information, respect community guidelines, and use the platform in compliance with applicable laws.
3. Health Disclaimer: Balansize provides well-being resources information only, and it does not replace professional medical advice. Please consult a healthcare provider before making significant lifestyle changes.
4. Account Security: You are responsible for maintaining the confidentiality of your login credentials. Notify us immediately if you suspect unauthorized access.
5. Subscription & Payments: Some features may require a subscription. By subscribing, you agree to our pricing, billing, and cancellation policies.
6. Prohibited Activities: Users must not misuse the platform, distribute harmful content, or engage in fraudulent activities.
7. Termination: We reserve the right to suspend or terminate accounts that violate these terms.
8. Modifications: Balansize may update these terms at any time. Continued use of the platform constitutes acceptance of the revised terms.
9. Use of Services
   1. You agree to use our platform solely for personal, non-transferable, and non-commercial purposes.
   2. You may not misuse, copy, or distribute any content from Balansize without permission.
   3. Payment by Visa or MasterCard debit and credit cards in AED

Important Legal Notice:

Emergency Situations
The Balansize platform is not designed for emergency situations, nor can it provide crisis intervention or urgent medical assistance. If you are in distress, contemplating self-harm or harm to others, or facing a medical emergency, you must stop using this platform immediately and contact emergency services by calling 999 or seeking urgent professional assistance.

Medical Disclaimer

The platform does not offer medical treatment, prescription services, or drug-related advice. Any information or guidance provided through the platform should not be considered medical advice and should not replace professional consultations with qualified healthcare providers.

Compliance with Applicable Laws

This User Agreement outlines the commitment of Balansize LLC to comply with the applicable laws governing the use of this platform in the United Arab Emirates (UAE). By accessing and using this platform, you expressly consent to be bound by this User Agreement, which is governed by the applicable laws of the UAE, including but not limited to:

1. The Constitution of the UAE (Federal Law No. 1 of 1971)
2. The UAE Penal Code (Federal Law No. 3 of 1987, as amended)
3. The UAE Cyber Crime Law (Federal Law No. 5 of 2012 regarding Information Technology Crime Control, as amended by Federal Law No. 12 of 2016 and Federal Law by Decree No. 2 of 2018)
4. The Telecommunications Regulation Law (Federal Law by Decree No. 3 of 2003, as amended) has rules about data protection and digital transactions that were made by the Telecommunications and Digital Government Regulatory Authority (TDRA).

For purposes of jurisdiction, the UAE is our country of domicile, and all disputes arising in connection with this User Agreement shall be exclusively adjudicated by the competent courts of the UAE.

We reserve the right to modify, suspend, or terminate any portion of this User Agreement or your use of the Platform without prior notice if we determine that you have violated any provision of this agreement or any applicable law.

Platform and Services

Balansize LLC is a well-being eco-platform designed to assist women at every stage of life, offering a comprehensive and personalized time-saving experience that integrates mental health, fitness, nutrition, and self-care.

Balansize LLC does not provide medical advice or healthcare services. The Platform serves as a resource for connecting users with wellness professionals, informative content, and holistic well-being resources. Users acknowledge that any reliance on the content provided is at their sole discretion and risk.

Professional Services and Responsibilities

The Platform may allow users to connect with wellness professionals, including but not limited to coaches, nutritionists, fitness trainers, and therapists. While we ensure that professionals listed on the Platform meet minimum qualifications, Balansize LLC does not assume liability for the quality or accuracy of the services provided by these professionals.

Users are responsible for evaluating and selecting professionals based on their own judgment. Balansize LLC does not endorse, supervise, or assume responsibility for any professional services provided through the Platform.

Users agree not to record, distribute, or reproduce any sessions or content obtained through the Platform without prior written consent from Balansize LLC.

Booking Services and Payments

Users can book wellness sessions and services through a subscription model or on a per-session basis. To book a session, users must:

• Register an account on the Platform
• Provide accurate personal and payment information
• Ensure that they use valid payment methods for transactions
• Select the service and expert 

All payments are processed securely through the Platform. Balansize LLC reserves the right to amend subscription plans, fees, or payment structures at its discretion.

Refund Policy: Payments made for booked sessions are generally non-refundable. However, if a session is canceled due to reasons attributable to Balansize LLC or the wellness professional, the user may be eligible for a refund. Refund requests must be submitted within 14 days of the issue via the Platform’s designated contact channels. Refund decisions will be made at the sole discretion of Balansize LLC.

User Conduct and Restrictions

By using this Platform, you agree to:

• Provide accurate and truthful personal information
• Refrain from misusing the Platform for unauthorized or unlawful purposes
• Not engage in harassment, discrimination, or any harmful conduct towards professionals or other users
• Respect intellectual property rights related to content, materials, and services provided through the Platform

Failure to adhere to these conditions may result in immediate account suspension or termination.

Data Protection and Privacy

Balansize LLC is committed to protecting user data in accordance with UAE data protection regulations. By using the platform (mobile application), you acknowledge and consent to the collection, processing, and storage of your personal data as outlined in our Privacy Policy.

We do not share or sell user data to third parties for commercial purposes. However, in compliance with legal requirements, Balansize LLC may be required to disclose user information to regulatory authorities upon request.

Users may opt out of marketing communications at any time by selecting the ‘unsubscribe’ option available in email communications.

Limitations of Liability

You hereby release Balansize LLC, its current and future officers, directors, employees, members, volunteers, contractors, representatives, parents, owners, affiliates, agents, successors, and assigns (collectively referred to as the “Balansize Related Parties”) and agree to indemnify the Balansize LLC Related Parties from any and all causes of action and claims of any nature arising from the counselor services or the platform, including, but not limited to, any act, omission, opinion, response, advice, suggestion, information, and/or service provided by any expert/counselor and/or any other content or information accessible through the platform.

You understand, accept, and acknowledge that the platform is offered “as is” without any express or implied warranties, including but not limited to merchantability, non-infringement, security, suitability for a certain purpose, or accuracy. Utilization of the platform is undertaken at your own risk and acceptance. To the maximum extent permitted by law, we explicitly reject all warranties, whether expressed or implied.

You understand, agree, and recognize that the Balansize LLC affiliated parties shall not be accountable to you or any third party for any indirect, incidental, consequential, special, punitive, or exemplary damages.

Emergency Disclaimer: If you are experiencing a medical emergency or crisis, DO NOT use this Platform. Instead, contact emergency services immediately by dialing 999 in the UAE.

Modifications and Termination

Balansize LLC reserves the right to:

• Modify the terms of this User Agreement at any time
• Suspend or terminate accounts for violations of terms or applicable laws
• Discontinue services, features, or platform functionalities at its discretion

Continued use of the Platform following any updates constitutes acceptance of the revised terms.

Intellectual Property Ownership and Third-Party Content

Balansize LLC is the sole proprietor or authorized licensee of all intellectual property rights related to the Platform. Text, graphics, logos, designs, software, and any other content that is published on the Platform are safeguarded by relevant intellectual property, trademark, and copyright laws in the United Arab Emirates and internationally.

Users are expressly prohibited from downloading, duplicating, reproducing, distributing, modifying, or utilizing any materials available on the Platform for any purpose other than personal, non-commercial use. Unauthorized use of the Platform’s content, such as hacking, reverse engineering, or attempting to disassemble the software, is strictly prohibited and may result in legal action.

Balansize LLC is not responsible for any interactions, communications, or transactions between users and third parties, including professionals, counselors, or advisors, who are engaged through the Platform, regardless of whether they are conducted online, offline, or through any other medium. If you download, print, reproduce, or copy any materials from the Platform in violation of these terms, you are obligated to discard or delete them immediately after personal use.

Disclaimer Regarding Third-Party Content

The Platform may include third-party content, services, or products, such as advertisements, links to third-party websites, or external resources (“Third-Party Content”). Balansize LLC does not endorse, control, or create such Third-Party Content and does not make any representations or warranties regarding its accuracy, reliability, security, or compliance with applicable laws. Balansize LLC shall not be held accountable for any damage, loss, or injury resulting from the user’s reliance on Third-Party Content.

Interactions, engagements, or transactions with third parties, including professionals listed on the Platform, are conducted at the discretion and risk of the user. Users acknowledge this. Balansize LLC expressly disclaims any liability that may result from such interactions, including professional advice, recommendations, or services rendered by third parties.

Service Availability and Platform Updates

At its sole discretion, Balansize LLC reserves the right to update, modify, or discontinue any features, services, or software on the Platform. In order to continue accessing specific services, users may be required to obtain updated versions of the Platform. The company Balansize LLC does not guarantee that future versions of the Platform will be compatible with all devices or operating systems. Users acknowledge that the company is not responsible for any loss, disruption, or inability to access services due to system updates, technical issues, or hardware/software incompatibility.

You acknowledge that Balansize LLC reserves the right to take appropriate legal action in the event of any violation and agree to comply with these terms by using the Platform.
